Case Summary

Class action by parents of several Negro children enrolled in public schools on their own behalf and on behalf of others similarly situated for injunctive relief against maintenance of racially segregated public schools. Plaintiffs moved for an injunction pendente lite. The District Court, Marovitz, J., held that plaintiffs were not entitled to injunctive relief pendente lite in view of substantial questions of fact that were raised as to whether segregation complained of was the result of an active and intentional design of defendants, and thus as to whether plaintiffs would ultimately prevail, and in view of failure of plaintiffs to demonstrate irreparable injury.
