MEMO ENDORSEMENT on re: 14 Letter, filed by Ann Prusinski, The Sullivan County Board of Elections, Rodney Gaebel. ENDORSEMENT: These cases (both) were transferred to me as part of a routine review and redistribution of work between the two S.D.N.Y. courthouses. As sometimes occurs, cases are sent from one courthouse to another in that process. These two cases were randomly chosen along with 80 others. (Thus, there was nothing unique to these cases which caused the transfer intra-district). I have both cases. I will handle both cases to conclusion. If, when we meet, and all parties discuss the discovery to occur -- the witnesses, documents, etc. do not overlap at all -- that will be very relevant to future coordination. Please note, the cases have not been "joined" -- they are not "consolidated". They are only, at this point - "coordinated". (Signed by Judge Katherine B. ORDER terminating 40 Letter Motion for Extension of Time. The Court is in receipt of the parties' August 7, 2015 letters regarding how discovery should proceed in light of the death of defendant Rodney Gaebel. [ECF Nos. 40, 41.] Document discovery with respect to Mr. Gaebel shall proceed only to the extent that discovery is sought of documents created or maintained by Mr. Gaebel in his official capacity; document discovery with respect to documents created or maintained by Mr. Gaebel in his personal capacity is hereby stayed until the appointment of a personal representative for his estate. The Court agrees with plaintiffs that defendants have failed to provide a justification for their request to stay all depositions until the appointment of a personal representative for Mr. Gaebel's estate. Therefore, documentary and depositional discovery shall continue to proceed as to all other parties. The Clerk of Court is directed to close the motion at ECF No. 40. (Signed by Judge Katherine B. ORDER terminating 76 Letter Motion for Discovery. The Court understands plaintiffs have not responded yet, but in the interests of time): The Court construes this letter, and that for Ms. Hoppe, as motions to quash. The Court is inclined to allow depositions on narrow, limited topics, for 1/2 day a piece, in Sullivan County. The parties shall confer (plaintiffs, defense counsel and counsel for the non-party deponents) on topics, timing and location. If agreement cannot be reached, let the Court know. Plaintiffs bear the burden of arriving at appropriate topics. (Signed by Judge Katherine B. Forrest on 12/17/2015) (lmb) (Entered: 12/17/2015)
