ORDER signed by JUDGE CATHERINE C. EAGLES on 07/20/2015. This matter is before the Court on the plaintiffs' Motions for Temporary Restraining Order and Preliminary Injunction. (Docs. 3, 7 .) A hearing on the motion for temporary restraining order has been tentatively set for Thursday, July 23. (Doc. 23 .) Because of the timing issues identified by the Guilford County Board of Elections in its response to the plaintiffs' motions, (Doc. 27 ), the Court proposes to hear both motions at the July 23 hearing. To that end, the parties may file any additional affidavits no later than Wednesday, July 22, at noon. 1 Counsel for the parties are directed to appear on July 23 at 9:30 a.m. in Courtroom 3 in Greensboro. The Court expects to limit the hearing to legal argument. If the plaintiffs object to any of the factual representations concerning election logistics and costs made by the County Board of Elections in the last paragraph of its brief, (Doc. 27 ), beginning on page 10 and carrying over to page 11, they shall file a specific written objection no later than July 21 at 6 p.m. and should support the objection with an affidavit or affidavits filed no later than July 22 at noon. In the absence of such an objection, the Court is prepared to accept those factual representations for purposes of the pending motions. The Court further directs the plaintiffs to include in their reply brief a discussion of whether the State Board of Elections or the State of North Carolina is a required party, and, if not, what representative of the state would be a feasible party. PRELIMINARY INJUNCTION. Signed by JUDGE CATHERINE C. EAGLES on 7/23/2015. For the reasons stated in its Memorandum Opinion as supplemented and summarized here, the Court GRANTS the plaintiffs' motion for preliminary injunction, (Doc. 7 ), and hereby ORDERS: 1. The defendant and its agents, officers, and employees are enjoined from enforcing, implementing, or giving any effect to Session Law 2015-138 in its entirety as it concerns municipal elections in Greensboro, except as specifically stated herein. 2. Elections for Greensboro City Council will take place using the electoral districts, method of election, and form of government that existed prior to the enactment of Session Law 2015-138. Specifically, five (5) council members will be elected to each represent a single district as those districts existed on July 1, 2015, three (3) council members will be elected at-large, and the mayor will be elected at-large. Pursuant to Rule 65(c) of the Federal Rules of Civil Procedure, the Court requires that the plaintiffs give security in the amount of one hundred dollars ($100) in connection with this Order. 5. This Order is subject to reconsideration upon motion by the defendant or under other appropriate circumstances. 6. To insure that this case is resolved well in advance of the 2017 municipal elections, the Magistrate Judge will enter appropriate scheduling orders concerning discovery, dispositive motions, and trial so that the entire process is completed no later than November 30, 2016. To ensure this schedule is met, the Court is likely to shorten briefing schedules as to any non-dispositive motions and is unlikely to grant extensions of time on dispositive motions.
