(This summary is temporary, while we research the case.) On January 8, 2020, the ACLU of New Mexico filed this lawsuit in Albuquerque District Court on behalf of a Native American student. The lawsuit alleged that a teacher at Albuquerque Public Schools created a hostile environment and discriminated against the Plaintiff in violation of the New Mexico Human Rights Act. On January 23, 2025, the New Mexico Supreme Court ruled that public schools must adhere to state anti-discrimination laws, and overturning 1981 precedent to the contrary.
