Here, the Texas Attorney General sued a nonprofit and an abortion provider for allegedly violating Texas’ total abortion ban.

Texas brought this lawsuit on February 24, 2026 in the District Court of Galveston against two physicians and two nonprofits that shipped medication abortion to all 50 states. One physician was a resident of and licensed in California, while the other was a citizen of the Netherlands and a licensed physician in Austria. The two nonprofits, Aid Access GmbH and Aid Access B.V. (collectively “Aid Access”), were incorporated and had their principal places of business in Austria and the Netherlands, respectively. 

Texas alleged that the Defendants advertised, prescribed, and mailed mifepristone and misoprostol – two medicines commonly used together to end a pregnancy – to Texas residents in violation of Texas law. Specifically, Texas alleged that the Defendants: violated the Human Life Protection Act (HLPA), Tex. Health & Safety Code § 170A.002; the state’s prohibitions on mailing abortion medication, Tex. Health & Safety Code § 171A.051; and Texas’s prohibitions on the unlicensed practice of medicine. Tex. Occ. Code § 155.001; Tex. Occ. Code § 165.159; Tex. Health & Safety Code § 170A.002(b)(1); id. § 171.003. Texas further alleged that the mailing of abortion medication into Texas caused Texas residents to have abortions.

Texas sought temporary and permanent injunctive relief, as to prevent Defendants from mailing abortion medication into Texas, as well as costs and attorneys’ fees.  

As of June 9, 2026, the case is ongoing.
