On March 29, 2006, the U.S. Equal Employment Opportunity Commission ("Plaintiff") filed an action under Title VII of the Civil Rights Act of 1964 against Defendant Homestore, Inc. in the U.S. District Court for the Central District of California, Western Division. Plaintiff claimed that Defendant engaged in unlawful employment practices by subjecting one of its employees ("the complainant") to employment discrimination based on his race, African-American. Specifically, Plaintiff alleges that …

On March 29, 2006, the U.S. Equal Employment Opportunity Commission ("Plaintiff") filed an action under Title VII of the Civil Rights Act of 1964 against Defendant Homestore, Inc. in the U.S. District Court for the Central District of California, Western Division. Plaintiff claimed that Defendant engaged in unlawful employment practices by subjecting one of its employees ("the complainant") to employment discrimination based on his race, African-American. Specifically, Plaintiff alleges that another one of Defendant's employees used derogatory racial slurs toward and in the presence of the complainant. Plaintiff further alleges that Defendant failed to take appropriate measures to prevent or remedy the allegedly hostile work environment.

On October 03, 2006, Plaintiff filed a First Amended Complaint. On February 15, 2007, Defendant filed a Motion for Summary Judgment. On June 01, 2007, the Court (Judge Otis D. Wright II) granted Defendant's Motion for Summary Judgment. The Court found no genuine issue as to any material fact and that Defendant was entitled to judgment as a matter of law. On June 12, 2007, judgment was entered in favor of Defendant.

Plaintiff appealed to the Ninth Circuit. On November 15, 2007, the Court of Appeals granted Plaintiff's motion for voluntary dismissal of the case. The appeal was dismissed.
