Case Summary

The EEOC's Memphis district office sued General Electric Company on April 26, 2001 in the U.S. District Court for the Western District of Tennessee. The EEOC's complaint alleged that the defendant violated the Americans with Disabilities Act when it discriminated based on physical disability (chronic pain and implanted narcotic pump) by failing to allow him to attend work after medical leave and discharging him. The parties entered into a settlement agreement on December 23, 2002, which stipulated that the defendant would pay the complainant $25,000 in backpay, and report semiannually to the EEOC about employees who took medical leave at the specified plant. The defendant was also required not to discriminate.
