Plaintiffs, a minority loan applicant and a fair housing non-profit, filed suit in the U.S. District Court for the Northern District of Indiana, alleging that Defendant-lender violated the Fair Housing Act, 42 U.S. 3601-3619, the Equal Credit Opportunity Act, 15 U.S.C. 1691, and federal civil rights statutes, 42 U.S.C. 1981, 1982, by discriminating against Plaintiff-loan applicant on the basis of her race. U.S. District Court Judge Richard Mills granted the Defendants' motion to dismiss after finding that the Defendant-lender had not rejected Plaintiff's loan application but had merely failed to act on it after two years, and that Plaintiff had failed to make out a prima facie case for redlining because Plaintiff had not alleged that the Defendant-lender had treated similarly situated white loan applicants in a different manner. The Seventh Circuit affirmed the District Court's rulings on July 14, 1989. Cartwright v. American Sav. & Loan Assoc., 880 F.2d 912 (7th Cir. 1989).
