Case Summary

On September 4, 1998, a female former employee of Sacramento Regional Transit filed a lawsuit under both Title VII of the Civil Rights Act, 42 U.S.C. § 2000e et. seq., and California's Fair Emplyment and Housing Act, Cal. On September 4, 1998, a female former employee of Sacramento Regional Transit filed a lawsuit under both Title VII of the Civil Rights Act, 42 U.S.C. § 2000e et. seq., and California's Fair Emplyment and Housing Act, Cal. Gov't Code § 12900, against Sacramento Regional Transit in the United States District Court of the Eastern District of California.

The plaintiff, represented by private counsel, asked the court for both monetary damages and injunctive relief, charging the defendant with discriminating against women in terms of hiring, promoting, training and determining salary, grade level, job description and job title.

On October 18, 1999, the plaintiff filed motion for class certification, which was clarified and granted by the court (Magistrate Judge John F. Moulds) on February 16, 2000. The class was certified in three parts as: (1) All current or former women employees of RT who applied for promotions but were denied or discouraged on the basis of gender discrimination; (2) All current or former women employees of RT who sought training and/or were discouraged from seeking such training by virtue of defendant's discriminatory policies and practices; and (3) All current or former women employees of RT who were salaried and discriminated against with regards to salary, job title, job description and/or grade level.

On July 24, 2000, the defendant filed motion for summary judgment. The court (Judge Moulds) subsequently denied the defendant's motion for summary judgment without prejudice on July 5, 2001.

On February 23, 2003, the court (Judge Moulds) issued an Order granting Final Approval of Class Settlement Consent Decree and final judgment, and the case was dismissed.

The agreement provided for extensive injunctive relief, compensatory damages of $42,857.00 to each of the named plaintiffs, and $900,000 for attorney's fees. Plaintiff's and Defendant's appeals of the Special Master's various orders after the consent decree were finalized were all resolved by May 10, 2007.
