Numerous incarcerated persons at Illinois' Stateville Correctional Facility filed this class action suit on April 1, 1982, in the U.S. District Court for the Northern District of Illinois. Defendants included various officials from the Illinois Department of Corrections. Judge James H. Alesia was assigned.

Plaintiffs challenged defendants’ failure to curtail violence between incarcerated individuals at Illinois' Stateville facility. Under 42 USC § 1983, they alleged this amounted to reckless disregard of incarcerated persons’ welfare in violation of the Eighth Amendment’s bar on cruel and unusual punishment. Specifically, defendants administered the Stateville in a way that encouraged repeated acts of violence including beatings, extortion, and sexual assault.

This case culminated in a consent decree on December 13, 1990, which mandated “improved protections from assault” at Stateville. The court continued to monitor implementation over the following years.
