On September 2, 2019, 18 prisoners filed this lawsuit in the U.S. District Court for the Southern District of New York. The plaintiffs sued the New York Department of Corrections (NYDC) and a group of its doctors under 42 U.S.C § 1983 for violations of the Eighth Amendment. Represented by private counsel, the plaintiffs sought damages, attorneys' fees, and an injunction against the defendants' practices and conditions for which this suit was brought. The plaintiffs also requested certification of a class of all present and future patients who require medications with abuse potential. The case was eventually assigned to Judge Loretta Preska.


In 2017, NYDC instituted the Medications With Abuse Potential (“MWAP”) Policy in response to the opioid epidemic, which intended to reduce the amount of pain medications in the New York prison system. After medical providers prescribed pain medications, the policy required additional approval from either a Regional Medical Director or the Chief Medical Officer before giving the pain medication to prisoners.


The plaintiffs claimed that the policy prevented prisoners from receiving pain medications needed for legitimate medical purposes. They alleged that the administrators that provided the extra approval invariably denied the pain medications. As a result, patients with medical issues including severe spinal and neurological issues, phantom pain from amputations, and multiple sclerosis, were denied pain medication.


On September 11, 2019 this case was related to another case involving a prisoner denied pain medication, captioned Medina v. Buther (7:15-cv-01955-LAP).


Plaintiffs amended their complaint on January 18, 2020, and in April 2020, defendants moved to dismiss the case for improper venue, failure to state a claim, and qualified immunity. On May 5, 2020, plaintiffs voluntarily dismissed their case against NYDC and two of the doctor defendants. On May 27, 2020, Judge Preska assigned the case to Magistrate Judge Sarah Netburn to begin settlement negotiations with the remaining doctor defendants.


On June 25, 2021, plaintiffs again amended their complaint, and on May 12, 2022, plaintiffs moved to certify two classes of plaintiffs: a liability class and an injunctive class. Plaintiffs defined the liability class as “all incarcerated individuals in the care and custody of the NYDC who suffered or will suffer from chronic pain and/or neuropathies for whom medications… were denied or discontinued without an individualized assessment of medical need or efficacy.” Plaintiffs additionally defined the injunctive class as “all incarcerated individuals who are or will be in the care and custody of NYDC who suffer or will suffer from chronic pain and/or neuropathies who require individualized assessments of medical need for treatment.”


On May 19, 2022, Judge Preska denied defendants’ motion to dismiss. 2022 WL 1597424. The court found that plaintiffs had adequately pled that (1) they were actually deprived of adequate medical care, (2) they suffered as a result of that deprivation. Thus, plaintiffs’ complaint satisfied the two-pronged test of deliberate indifference. The court also found that it would be premature to grant qualified immunity to the defendants, as such immunity depended on several unsettled fact-based questions.


Following motion practice, the court certified the injunctive class but denied the certification of the liability class on March 31, 2023. 2023 WL 2731733.The court denied certification of the liability class on the grounds that a plaintiff cannot bring a class action against parties that did not injure her. Because none of the plaintiffs was alleged to have been injured by all of the named defendants, the court denied certification of the liability class. However, the court certified the injunctive class and adopted plaintiffs’ definition of the class.


On May 20, 2022, Plaintiffs moved for preliminary injunction, asking that the court prohibit defendants from implementing or continuing any policies that prevented prisoners from receiving pain medications needed for legitimate medical purposes. Following an evidentiary hearing on February 9, 2023, the court granted plaintiffs’ motion for preliminary injunction on March 31, 2023. The court found that plaintiffs had a substantial likelihood of success on the merits of their deliberate indifference claim, that harm to plaintiffs absent the injunction was irreparable, and that it was in the public interest to grant the injunction. However, the court reserved its ruling on the provisions of the injunction in order to hear from all parties. 2023 WL 2752375.


The court issued class-wide preliminary injunction on June 12, 2023. 2023 WL 3948533. The court ordered that 1) After a patient is prescribed any medication for a chronic pain condition, there should be no approval process with limited exceptions for non-formulary medications; 2) Specialty consultations would be ordered as indicated for the evaluation and care of chronic pain patients; 3) Pain management medication should not be continued without consultation between the provider and patient; and 4) Patients with chronic pain would be seen by medical personnel at least every 90 days. The court’s injunction also required detailed documentation of the treatment of chronic pain by NYDC and its medical personnel.


As of June 2023, this case is ongoing.
