The motion is DENIED WITHOUT PREJUDICE to the extent it seeks partial summary judgment on the first and third causes of action alleged in Plaintiffs' First Amended Complaint. FURTHER that Defendants' Motion to Dismiss, (ECF No. 30 ), is hereby DENIED.
