Given the COVID-19 pandemic, the plaintiffs alleged that the lack of live ASL accommodations discriminated against people with disabilities residing in New York. The court granted the plaintiffs a preliminary injunction and the parties later settled, with the Governor agreeing to provide live televised in-frame ASL interpretation at COVID-19 press briefings.


On April 29, 2020, four individuals with disabilities and Disability Rights New York filed this lawsuit in the U.S. District Court for the Southern District of New York against Andrew Cuomo, the Governor of New York, seeking declaratory and injunctive relief as well as attorney fees. The plaintiffs alleged that the absence of live televised American Sign Language (ASL) interpretation in Governor Cuomo’s daily televised briefings on COVID-19 discriminated against people with disabilities residing in New York, violating the Americans with Disabilities Act (ADA) and Section 504 of the Rehabilitation Act. Further, the plaintiffs added that New York residents already faced disproportionate health risks from the pandemic and that every other state in the nation had provided some form of live televised ASL interpretation. The case was assigned to Judge Valerie E. Canroni.

The same day they filed the complaint, the plaintiffs sought a temporary restraining order and preliminary injunction requiring New York to immediately include live in-frame ASL interpretation for all the Governor's briefings addressed to New York residents. In response, the defendant argued, among other things, that New York complied with the ADA and Section 504 by providing real time closed captioning, a simultaneous ASL broadcast available via the Governor’s website, and press releases distributed by email.

The court granted the preliminary injunction on May 11, 2020, and ordered Governor Cuomo to immediately implement live, in-frame ASL interpretation for his daily press briefings. The following day, the court issued an opinion explaining its rationale for granting preliminary relief. The court found that the plaintiffs had demonstrated a clear and substantial likelihood of success on the merits. Disagreeing with the Governor’s assertion that the existing accommodations adequately ensured meaningful access to press briefings, the court concluded that—for these specific plaintiffs and similarly situated deaf New Yorkers—the Governor had failed to make the necessary reasonable accommodations. The court explained that the ASL webstreams were not readily accessible to those who lacked internet access and closed captioning did not adequately accommodate those who could not read English. Calling the Governor’s suggestion that the plaintiffs were choosing not to take advantage of the provided accommodations “unfounded, conclusory, and cavalier,” the court determined that in-frame ASL interpretation was necessary to ensure the plaintiffs meaningful access to the press briefings. The court discussed the “vital and continually changing information” surrounding COVID-19, and found that, absent meaningful access to that information, the plaintiffs were subject to actual and imminent injury that could not be remedied at a later date. Noting that implementing an in-frame ASL interpreter would not be burdensome and that the plaintiffs could not follow executive orders or health department recommendations of which they were unaware, the court found that the balance of the hardships and the public interest both weighed in favor of granting injunctive relief. 2020 WL 2393285.

The parties participated in a settlement conference on May 19, 2020, during which they reached an agreement to resolve the case. Pursuant to the settlement agreement, the Governor agreed to provide live televised in-frame ASL interpretation at any and all COVID-19 press briefings. Additionally, the State of New York, on behalf of the Governor, agreed to pay the plaintiffs’ counsel attorney fees in the amount of $30,550.

The court entered the stipulated settlement agreement and dismissed the case with prejudice on June 29, 2020.
