COVID-19 Summary: This is an action brought by South Carolina voters, candidates, and democratic organizations, seeking to enjoin various voting restrictions in the South Carolina law. Some of their claims were mooted as to the June elections as South Carolina legislation passed on May 12 allowed voters to vote by absentee ballot. On May 25, the court partially granted a preliminary injunction, enjoining the witness requirement for the June 2020 primaries.


On May 1, 2020 several South Carolina political candidates and voters, as well as the South Carolina Democratic Party, the Democratic National Committee, and the Democratic Congressional Campaign Committee, filed this action in the U.S. District Court for the District of South Carolina, seeking relief from five voting provisions in the state law:

(1) the "Absentee Ballot Age Restriction," which prohibited all voters under 65 from casting mail-in ballots unless they are disabled or confined in jail; (2) the "Postage Tax," which required voters to pay postage for their absentee ballot if they wished to vote; (3) the "Election Day Cutoff," which rejected ballots not received by 7 pm on election day; (4) the "Absentee Assistance Ban," which prohibited candidates or paid campaign staff from assisting absentee voters; and (5) the "Witness Requirement," which required a witness to sign the absentee ballot in order for the vote to be counted.

The plaintiffs, represented by private counsel, sued the South Carolina State Election Commission and the Election Commissioner. They sought declaratory and injunctive relief under 42 U.S.C. § 1983 and 28 U.S.C. §§ 2201-02 for violations of the First, Fourteenth, Twenty-Fourth, and Twenty-Sixth Amendments, as well as the Voting Rights Act, 52 U.S.C. §§ 10301-02. Specifically, the plaintiffs alleged that South Carolina's laws surrounding absentee voting unconstitutionally burdened the rights of some voters, especially in light of the COVID-19 pandemic. The case was assigned to Judge Michelle Childs.

On May 7, the plaintiffs filed a motion for preliminary injunction to stop the defendants from enforcing the Absentee Ballot Age Restriction, the Witness Requirement, and the Election Day Cutoff. They also requested the court to consolidate the motion hearing with another action where the plaintiffs had filed a motion for preliminary injunction against the same defendants.

The South Carolina Republican Party moved to intervene on May 11, which was granted on May 12.

Additionally, on May 12, the South Carolina General Assembly passed legislation allowing all qualified South Carolina voters to vote by absentee ballot for the June 9 primary and the June 23 runoff election. These legislative changes mooted the plaintiffs' requests as to the Excuse Requirement and the Absentee Ballot Age Requirement for the June primaries. In light of the hearing scheduled for May 15, the plaintiffs attempted to extend their request for relief beyond the June primaries. The court limited the issues for the hearing, stating that the plaintiff's motion for preliminary injunction clearly sought only relief for June, and as such, the defendants had not been given proper notice.

The defendants and intervenors filed oppositions to the plaintiffs' motion for preliminary injunction on May 14.

On May 25, the court granted the motion for preliminary injunction in part, enjoining the defendants from enforcing the Witness Requirement for the June 2020 primaries. The defendants were also ordered to immediately and publicly inform South Carolina voters of the elimination of the witness requirement. 613 F.Supp.3d 926.

The case is ongoing.

TEXT ORDER: The court observes that on May 12, 2020, the South Carolina General Assembly passed legislation that now allows all qualified South Carolina voters to vote via absentee ballot for the June 9, 2020 and June 23, 2020 Primaries due to the current state of emergency. S.635 (2020). Governor McMaster signed the bill into law on May 13, 2020. The pertinent portion of the bill states, as follows, in Section 2(A): "Elections, absentee ballots during the state of emergency, expiring on July 1, 2020" SECTION 2. A. A qualified elector must be permitted to vote by absentee ballot in an election if the qualified elector's place of residence or polling place is located in an area subject to a state of emergency declared by the Governor and there are fewer than forty six days remaining until the date of the election. The court determines, based on the aforementioned change in law, that Plaintiff Thomas' Preliminary Injunction Motion as it pertains to the challenged "Excuse Requirement" affecting the June Primaries and Plaintiff Middleton's Preliminary Injunction Motion as it relates to the "Absentee Ballot Age Requirement" affecting the June Primaries are MOOT because there is no longer any case or controversy as to those limited aspects of the case. As a result, the court deems it unnecessary to hear arguments relating to the "Excuse Requirement" or the "Absentee Ballot Age Requirement" at the Friday, May 15, 2020 Hearing. In order for the court and all parties to be properly prepared for the hearing, the court DIRECTS the parties to submit, in writing, any remaining issues that any party intends to address to the court. TEXT ORDER: This matter is before the court to address the posture of the May 15, 2020 hearing on Plaintiffs' Motions for Preliminary Injunction. The court observes that in response to its request for the parties to submit in writing the issues they intended to present at the hearing, Middleton Plaintiffs stated that "the Excuse Requirement and Absentee Ballot Age Requirement are not moot with respect to that election and other elections occurring after July 1, 2020." Middleton v. Andino, C/A No.: 3:20-cv-01730-JMC, ECF No. 31 at 1 (D.S.C May 14, 2020) (emphasis added). Upon the court's review of Middleton Plaintiffs' Motion for Preliminary Injunction (id. at ECF No. 13), it is clear that the injunctive relief sought is in connection with the June 2020 primaries. For this reason, the court finds that it cannot consider argument on elections after the June 2020 primaries because Defendants did not receive proper notice under Rule 65(a)(1) of the Federal Rules of Civil Procedure. Therefore, the court advises the parties that the May 15, 2020 hearing will be limited to the remaining issues pertaining to the June 2020 primaries. If an appropriate motion for injunctive relief addressing the Excuse Requirement and the Absentee Ballot Age Requirement with respect to any other election is filed, the court will consider that matter at the appropriate time. TEXT ORDER The matter before the court is Plaintiffs Kylon Middleton, Deon Tedder, Amos Wells, Carlyle Dixon, Tonya Winbush, Ernestine Moore, the South Carolina Democratic Party ("SCDP"), Democratic National Committee ("DNC"), and DCCC's Motion for Leave to Amend their Complaint (ECF No. 67). In their Motion, Plaintiffs "certify that they have obtained the written consent of Defendants for the Amendment." (Id. at 2.) Pursuant to Rule 15(a)(2) of the Federal Rules of Civil Procedure, after the time has passed to amend a pleading as a matter of course, "a party may amend its pleading only with the opposing party's written consent or the court's leave. The court should freely give leave when justice so requires." Rule 15(a) is a "liberal rule [that] gives effect to the federal policy in favor of resolving cases on their merits instead of disposing of them on technicalities." Laber v.
