On July 30, 2020, six individual plaintiffs and the Kentucky Alliance Against Racial and Political Repression (KAARPR) filed this putative class-action lawsuit in the United States District Court for the Western District of Kentucky. They were represented by attorneys from the NAACP Legal Defense and Educational Fund, the ACLU of Kentucky Foundation, and private counsel. They brought suit against the Louisville/Jefferson County metro government (Louisville Metro), the mayor of Louisville, the interim chief of Louisville Police, and over a dozen Louisville Police Department officers. The complaint arose out of the protests that swept the country following the police killings of George Floyd in May of 2020 and of Breonna Taylor (by Louisville police) in March of 2020. The complaint alleged that during the Louisville protests, police used tear gas, pepper balls, and flash bang grenades against the protesters, resulting in at least one fatality where live ammunition was used. The complaint argued that these actions represented violations of the US Constitution and common law tort law. Specifically, the complaint argued that the defendants' First Amendment right to free speech and assembly, and their Fourth Amendment protection against excessive force were violated. The complaint also argued that defendants' actions constituted common law battery and assault. The case was assigned to District Judge Charles R. Simpson III.

Plaintiffs submitted an amended complaint on September 11, 2020. The amended complaint added a plaintiff but left the substance of the complaint unchanged.

On August 21, 2020, defendants partially moved to dismiss for failure to state a claim, a claim they amended on September 22, 2020. Plaintiffs responded to the motion on October 13, 2020, voluntarily dismissing their state law claims against Louisville Metro. The defendants replied on October 27, 2020. On November 25, 2020, the court granted in part and denied in part the motion. The court granted dismissal with prejudice of the assault and battery claims against Louisville Metro, in accordance with the plaintiffs’ voluntary dismissal. The court also dismissed the claims against the officers in their official capacity, because they were duplicative of the claims against Louisville Metro. However, the court denied dismissal of the § 1983 claims against Louisville Metro because there was a pattern of constitutional violations that could reasonably suggest a custom of acquiescence, and because the complaint contained sufficient factual matter to state a claim that was plausible on its face.

On December 8, 2020, the case was reassigned to District Judge Benjamin Beaton. On December 22, 2020, the case was referred to Magistrate Judge Colin. H. Lindsay for all pretrial matters. Over the next two years, the parties continued with discovery. On September 26, 2022, the parties were ordered to engage in settlement discussions. 

The defendants filed a motion for a protective order and a motion to quash Mayor Greenberg’s deposition on May 19, 2023. The court found that the defendants failed to demonstrate why Mayor Greenberg would suffer a particularized harm if deposed (with the court mentioning the absence of any indication that it would be difficult with his schedule, for instance). Also, even though the mayor is a high-ranking official usually not normally subject to depositions, Mayor Greenberg had firsthand knowledge of the matters at issue in the case (even though he didn’t become mayor until 2023, plaintiffs sought forward-looking injunctive relief). Though the court denied Louisville Metro’s motion, the court directed the parties to jointly produce a list of relevant topics to limit the scope of the mayor’s testimony.

This case is ongoing as of December 22, 2023.
