This is a 2020 case about voting by mail during pandemics and other disasters in Nevada. Nevada passed Assembly Bill 4 (AB4) on August 2, 2020. AB4 allowed areas impacted by a pandemic or other disaster to expand their use of mail-in and absentee voting, effective in time for the November 2020 election. AB4 Sections 11 and 12 also authorized particular numbers of polling places depending on county populations. On August 4, 2020, plaintiffs Donald J. Trump for President, the Republican National Committee, and the Nevada Republican Party challenged AB4 in the United States District Court, District of Nevada. Represented by private firms, Trump and the Republican organizations sued the state of Nevada. They sought injunctive relief, declaratory judgment, and reasonable costs, expenses, and attorneys' fees.

Plaintiffs' alleged that that AB4 (1) conflicted with federal law and was preempted by the Supremacy Clause, (2) violated the Equal Protection Clause of the Fourteenth Amendment by authorizing more polling places per capita in urban areas than in rural areas and by failing to provide standards to ensure fairness and non-arbitrariness; and (3) violated the right to vote. The case was first assigned to Judge Kent J. Dawson, who recused himself in this action. The case was subsequently randomly reassigned to Judge James C. Mahan.

On August 7, 2020, the Democratic National Committee (DNC) and Nevada State Democratic Party (NSDP) motioned to intervene as additional defendants, which was eventually granted. On August 10, 2020, Nevada motioned to dismiss the case, arguing that Plaintiffs had no standing, had not proven injury, and that the claims should fail on the merits.

On August 20, 2020, Plaintiffs amended their complaint to add additional allegations. Shortly thereafter, on August 24, Nevada again motioned to dismiss the new amended complaint. Intervenors DNC and NSDP also motioned to dismiss in a separate September 3 filing. On September 4, 2020, Plaintiffs motioned for partial summary judgment.

After additional briefing from all involved parties, Judge Mahan granted the defendants' motion to dismiss on September 18, 2020. He concluded that Plaintiffs did not have associational, organizational, or competitive standing. His justifications included that Plaintiffs' claims were too "generalized" and "speculative" to establish injury. Judge Mahan also said that Plaintiffs failed to show redressability—in order words, how blocking AB4 would redress their Equal Protection claims. Along with dismissing the case, he declared all pending issues moot. 488 F.Supp.3d 993. Judge Mahan issued a final judgment in favor of the defendants on September 21, 2020, concluding the case.

Separate from this case, in April 2020, Democratic Nevada voters, the Nevada State Democratic Party, the DNC, the Democratic Congressional Campaign Committee, and Priorities USA filed a lawsuit in Nevada state trial court regarding mail-in ballots and the pandemic. Read about that case here.
