This is a case brought by voting rights organizations and individuals because of the health risks of absentee voting regulations during the COVID-19 pandemic. On August 27, 2020, the League of Women Voters Mississippi, Mississippi State Conference of the NAACP, and three individuals filed this lawsuit in the U.S. District Court for the Southern District of Mississippi. The plaintiffs sued the state of Mississippi under the First and Fourteenth Amendments.

Represented by the Southern Poverty Law Center, the Lawyers’ Committee for Civil Rights Under Law, and a private firm, the plaintiffs sought three declarations: 1) that that they were eligible to vote absentee due to the risk of contracting COVID-19 in-person; 2) the notarization requirement for a ballot violates the right to vote; and 3) the defendants’ failure to provide adequate notice and opportunity to cure (fix ballot and match signatures) the rejection of absentee ballots is illegal. The case was assigned to Judge F. Keith Ball.

On September 17th, plaintiffs filed a motion for a preliminary injunction, which they withdrew on October 12th. On October 8th, the defendant filed a motion to dismiss due to lack of standing. On October 20, 2020, the court dismissed the suit without prejudice, under Federal Rule of Civil Procedure 41(a)(2), with agreement of the parties, in light of the state’s new ‘notice and cure’ process, as well as the availability of curbside voting.
