Case Summary

This is a case about a change of rules by the Department of Homeland Security (DHS) which curtailed access to employment authorization documents (EADs) by asylum seekers. This is a case about a change of rules by the Department of Homeland Security (DHS) which curtailed access to employment authorization documents (EADs) by asylum seekers. On December 23, 2020, three nonprofit organizations and fourteen noncitizen asylum seekers filed this lawsuit in United States District Court for the District of Columbia. The plaintiffs sued DHS, the Secretary of DHS, and General Counsel for DHS under the Administrative Procedures Act (APA). Represented by National Immigrant Justice Center, the plaintiffs sought injunctive relief to vacate two agency rules that curtailed access to EADs. Specially, they claimed that the rules changed by DHS were arbitrary and capricious and contrary to the Immigration and Nationality Act (INA). They also claimed that Acting DHS Secretary was not validly serving as Acting DHS Secretary under the Homeland Security Act, Federal Vacancies Reform Act, and the Appointments Clause of the Constitution when he signed the rules. The case was assigned to Judge Beryl Howell.

The challenged Timeline Repeal Rule removed the requirement that United States Citizenship and Immigration Services (USCIS) respond to an application for EAD within 30 days of filing, which resulted in asylum seekers waiting indefinitely for a decision on their application. The challenged EAD Bar Rule included USCIS regulations which created additional barriers to asylum applicants’ access to work authorization. The complaint detailed the critical role that EADs serve in assisting asylum seekers to obtain government services, housing, healthcare, and work.

The plaintiffs filed an amended complaint on March 23, 2021, adding five additional individual plaintiffs and removing one. The amended complaint also addressed pertinent events that occurred subsequent to the initial complaints’ filing, such as personnel changes in DHS and the Secretary’s attempt to ratify the rules in January 2021.

Subsequently, on April 22, 2021, the defendants filed a motion to stay prior to filing an answer. In denying the stay on June 1, the court rejected the defendants’ arguments that the parallel proceedings in Casa de Maryland v. Mayorkas and changes in DHS leadership might moot or reshape the case. According to the court, the potential impact of the Maryland court’s decision here was too speculative in both timing and scope, and defendants offered no evidence that DHS planned to alter or repeal the rules. 2021 WL 2227335.

The asylum seekers filed a motion for partial summary judgment on June 9, 2021, and the defendants filed a motion for partial summary judgment on July 28, 2021. On February 7, 2022, the court granted the asylum seekers’ motion for summary judgment on their claim that Wolf’s appointment was invalid. The court noted that five other district courts and another judge in the U.S. District Court for the District of Columbia had already concluded that Wolf’s appointment as Acting Secretary was invalid. See Pangea Legal Servs. v. U.S. Dep’t of Homeland Sec., 512 F. Supp. 3d 966 (N.D. Cal. 2021); Batalla Vidal v. Wolf, 501 F. Supp. 3d 117 (E.D.N.Y. 2020); Nw. Imm. Rights. Proj. v. USCIS, 496 F. Supp. 3d 31 (D.D.C. 2020); Imm. Legal Res. Ctr. v. Wolf, 491 F. Supp. 3d 520 (N.D. Cal. 2020); Casa de Md., Inc. v. Wolf, 486 F. Supp. 3d 928 (D. Md. 2020); La Clinica De La Raza v. Trump, No. 19-cv-4980, 2020 WL 7053313 (N.D. Cal. Nov. 25, 2020). The court found no reason to depart from the other decisions. Because Wolf’s appointment was invalid, the Timeline Repeal Rule and the EAD Bar rule were vacated. The court denied DHS’s cross-motion for summary judgment.

The case is ongoing.

MINUTE ORDER (paperless) GRANTING plaintiffs' 10 Motion for Leave to Amend. "Leave to amend a complaint under Rule 15(a) 'shall be freely given when justice so requires.'" Firestone v. Firestone, 76 F.3d 1205, 1208 (D.C. Cir. 1996) (quoting Fed. R. Civ. P. 15(a)). Leave to amend may ordinarily be denied based only on sufficient reasons, such as "undue delay, bad faith or dilatory motive on the part of the movant, repeated failure to cure deficiencies by amendments previously allowed, undue prejudice to the opposing party by virtue of allowance of the amendment, [and] futility of amendment." Foman v. Davis, 371 U.S. 178, 182 (1962). None of the reasons enumerated in Foman that would warrant denial of leave to amend the complaint under Rule 15(a) is present here, and defendants do not oppose plaintiffs' motion. Accordingly, plaintiffs' motion to amend their complaint is GRANTED. Signed by Chief Judge Beryl A. Howell on March 23, 2021. (lcbah2)

MINUTE ORDER (paperless) DENYING plaintiffs' 35 Motion for Authorization of the Appearance of Misha Boutilier. Several licensed attorneys have already appeared for plaintiffs in this case and could participate in any oral argument that the Court may schedule before ruling on plaintiffs' pending 25 Motion for Partial Summary Judgment. There is therefore no special need for the Court to grant this exceptional request when, as plaintiffs explain, Local Rule 83.4, which governs the practice in this Court by law students, "does not apply to Mr. Boutilier's precise circumstances," Mot. at 3, because he is a law school graduate with more than three years of legal experience. Should this matter remain pending then, Mr. Boutilier is invited to seek pro hac vice admission once he is admitted to the New York Bar. Signed by Chief Judge Beryl A. Howell on September 23, 2021.
