Thirteen demonstrators protesting George Floyd's murder filed this lawsuit on July 8, 2020 in the U.S. District Court for the Southern District of Ohio against the city of Columbus, Ohio and various law enforcement officers in their official and individual capacities for the alleged use of excessive force. Represented by private counsel, the plaintiffs brought this suit under 42 U.S.C. § 1983, alleging that police officers used pepper spray and rubber bullets, among other crowd-control methods, without first giving warning to the protestors. The plaintiffs alleged violations of their First Amendment right to assemble and their Fourth Amendment right to be free from excessive force, as well as state law claims of gross negligence, battery, and malicious prosecution. The plaintiffs sought declaratory judgment, injunctive relief enjoining defendants from using similar conduct in the future, compensatory damages, punitive damages, and attorneys' fees and costs.

The case was assigned to Judge Algenon Marbley. On September 16, 2020, the plaintiffs filed an amended complaint, adding additional individual named plaintiffs and an additional state law claim. Two months later, the plaintiffs filed a motion for preliminary injunction, seeking to enjoin the defendants from using non-lethal force such as tear gas, flash-bang grenades, or batons on nonviolent protestors. On April 30, 2021, Judge Marbley granted the preliminary injunction. 2021 WL 1725554. In a lengthy opinion that began by recounting how "formal policing took its earliest form in slave patrols," Judge Marbley enjoined the defendants from using non-lethal force (including tear gas, flash-bang grenades, rubber bullets, batons, etc.) to disperse nonviolent protestors. Instead, defendants could only use citations or arrests. The defendants were also ordered to ensure that their body cameras were in good working order. 

On May 27, 2021, the plaintiffs filed a second amended complaint, adding six new plaintiffs and 17 additional named defendants and otherwise retaining most of the elements of the first amended complaint. On June 25, 2021, Judge Marbley granted a joint motion to modify the preliminary injunction. The modifications (1) narrowed the entities and individuals directly enjoined to be the City of Columbus, including its Division of Police, removing individual police officers from the preliminary injunction; and (2) narrowed the reference to "streets" by excluding "expressways and freeways." Three days later, he granted a joint motion to stay proceedings while the parties engaged in settlement talks.

On December 22, 2021, the parties filed a settlement agreement and agreed permanent injunction, which was approved by the court on December 29. Under the terms of the agreement, the City of Columbus agreed to pay the plaintiffs and their attorneys $5.75 million. In addition, the permanent injunction provided a variety of injunctive relief:

  • restrained the City of Columbus, including its Division of Police, from using non-lethal force against nonviolent protestors to enforce dispersal orders, traffic laws, and/or misdemeanors;
  • prohibited the defendant from using the infliction of pain to punish or deter nonviolent protestors;
  • directed the defendant to avoid infliction of pain on any nonviolent protestor incidental to arrest;
  • required the defendant to ensure that body and vehicle cameras were in good working order and used during every interaction with nonviolent protestors and that badge numbers and/or identity cards remain prominnetly displayed;
  • prohibited plain clothes or undercover officers from engaging in enforcement actions absent exigent circumstances
  • order the defendant to recognize that members of the press, medics, and legal observers are permitted to be present in a position enabling them to record protests and/or intervene to assist indiciduals; and
  • required the defendant to request that mutual aid law enforcement personnel who cooperate with them adhere to the restraints set out in the injunction.

The case was closed, but the court retained jurisdiction for the purpose of enforcing the terms of the settlement agreement.
