This is a case challenging the Pasco County Sheriff's Office's "Intelligence-Led Policing Program," or ILP Practices. The plaintiffs sued Sheriff Nocco in the U.S. District Court for the Middle District of Florida, alleging that the program created a list of individuals believed likely to commit future crimes and then subjected those individuals and their families to “relentless pursuit, arrest, and prosecution” in violation of the First Amendment freedom of assembly and the Fourteenth Amendment Due Process Clause. The plaintiffs also claimed violations for their Fourth Amendment protection from unreasonable search and seizure. Attorneys from the Institute for Justice represented plaintiffs in their suit, and Judge Steven D. Merryday presided over the case.

The plaintiffs included individuals identified as "Targeted Persons" by the Sheriff's Office, as well as individuals whose children the sheriff's office identified as "Targeted Persons." They alleged that deputies within the sheriff's office came to their homes and, for example, threatened them with arrest if they refused to comply with unwarranted searches of their homes and arrested plaintiffs and their family members for minor violations on their private property. In at least one instance, the deputies told the plaintiffs they were following direct orders from Sheriff Nocco. The plaintiffs sought declaratory relief, compensatory damages, and a permanent injunction barring future enforcement of the program.

In April, 2021, the defendant moved to dismiss for failure to state a claim. In August, 2021, the motion was granted-in part, dismissing one count brought by the plaintiffs. The court provided the plaintiffs an opportunity to correct their complaint, and on August 27, 2021, the plaintiffs submitted an amended complaint. The defendant, in response, filed another motion to dismiss, specifically relating to Count V of the amended complaint, alleging violations of the Fourteenth Amendment Equal Protection Clause for all Plaintiffs. That motion was granted on March 31, 2022, and Count V was dismissed. The court found that heightened scrutiny was not warranted, as plaintiffs had argued, because they were not part of a suspect class and the law did not recognize a fundamental right “to be free from arrest.”

The parties continued to engage in discovery and mediation regarding the remaining viable counts in the suit. Mediation resulted in an impasse on April 28, 2022.

On June 6, 2022, the defendant filed a motion for summary judgment, which was later amended on June 28, 2022. The plaintiffs filed a motion for summary judgment on liability on June 6, 2022, which was later corrected on June 27, 2022. A hearing was held before Magistrate Judge Tuite on November 3, 2022.

On December 28, 2022, Magistrate Judge Tuite denied both parties’ motions for summary judgment to allow time for limited discovery regarding changes to ILP Practices. Both parties then renewed their motions on March 14, 2023. As of of June 2, 2023, these motions are pending before Magistrate Judge Tuite, and the case is ongoing.
