Several blind social security recipients and the National Federation of the Blind, Inc. (NFB) brought this lawsuit against the Social Security Administration (SSA) in the U.S. District Court for the Southern District of California. Plaintiffs alleged that the SSA did not provide blind people with accessible kiosks at its offices.

In their complaint, Plaintiffs alleged that the SSA was violating blind individuals' civil rights by failing to provide access to check-in kiosks for blind individuals at its offices. At all of its field offices, SSA provides touchscreen Visitor Intake Processing (VIPr) kiosks to visitors. Typically, visitors need to use the kiosks to check-in before appointments and must enter various sensitive information, including social security numbers. Sighted individuals are able to enter their personal information using the touchscreen without revealing any sensitive information, but blind individuals encountered accessibility barriers to access. The plaintiffs alleged that the VIPr kiosks either lacked non-visual accessibility features or that the features malfunctioned or weren't properly configured. Consequently, blind visitors could not independently access the kiosks and had to rely on security guards, members or the public, or sighted companions to use the kiosks. NFB alerted SSA to the accessibility problem in 2015, but NFB members, including the named Plaintiffs, continued to encounter accessibility barriers.

Plaintiffs sought a declaratory judgment that the Defendant's failure to ensure that SSA provides accessible VIPr kiosks to blind individuals violated Section 504 of the Rehabilitation Act and that Defendant had a duty to provide access to SSA's kiosks in secure environments. Plaintiffs also sought injunctive relief in the form of an order requiring Defendant to provide access to SSA's kiosks to visually impaired individuals, develop policies and procedures to ensure all VIPr kiosks are fitted with accessibility technology and remain accessible in future.

The case was assigned to Judge Cynthia Bashant and Magistrate Judge Karen S. Crawford. In December 2017, the parties filed a joint motion to stay proceedings to facilitate settlement negotiations. Judge Bashant granted the order, and parties began settlement negotiations. In February 2020, the parties filed a joint order to dismiss and order the settlement agreement to be enforced. On March 12, 2020, Judge Bashant signed the settlement agreement and ordered the case dismissed.

Under the settlement agreement, Defendants admitted no liability but agreed to retain a third-party kiosk accessibility expert to conduct and evaluate reports concerning VIPr Kiosks' compliance with the settlement agreement. The SSA also agreed to develop and implement an enhanced VIPr System that would meet various requirements. Under the agreement VIPr kiosks need to meet Section 508 accessibility standards and must have accessible audio headphone jacks and courtesy headphones and improved Braille instructions. Additionally, all private or sensitive information that would be available visually via the touchscreen must be available nonvisually through the audio function. The agreement also including various timing requirements. Within 90 days of the effective date and every 90 days afterward for the duration of the agreement, the SSA will submit a written report summarizing the status of the Kiosk redesign and the Consultant's work during the reporting period. The agreement will last for four years with an option to extend for an additional year.

The case remains open.
