On September 23, 2016, an individual who was deaf and detained at Clackamas County Jail, alleged that the County discriminated against deaf individuals by failing to provide accommodations in booking procedures and in other aspects of detention. For example, the County failed to provide effective means of deaf detainees to communicate with people out of jail; the County failed to provide deaf individuals with adequate notification of important daily events; and the County failed to provide closed captioning for its Prison Rape Prevention Act video. The plaintiffs alleged that these failures (among many others) amounted to violations of the Americans with Disability Act, the Rehabilitation Act, and Oregon state law. The plaintiff, represented by the Law Offices of Daniel Snyder (a private law firm), sought compensatory damages, including injunctive and declaratory relief, and attorney’s fees. The complaint named Clackamas County and Corizon Health, Inc. as defendants. The case was assigned to Magistrate Judge Paul Papak.

Also in the complaint, the plaintiff noted that he sought to certify a class consisting of “all deaf or hard of hearing inmates who formerly were or currently are incarcerated in the Clackamas County Jail, or who will become incarcerated in said jail in the future.”

Within a few months after the complaint was filed, the parties agreed to the County’s dismissal, and the case continued with Corizon Health as the sole defendant. Corizon Health was responsible for managing the medical and mental health services for detainees at Clackamas County Jail.

The first major ruling in the case came on April 28, 2017 when US District Court Judge Anna J. Brown dismissed with prejudice the plaintiff’s claim based on Title II of the ADA, and dismissed without prejudice the plaintiff’s claims based on Title III of the ADA and state law. 2017 WL 1658821.

Then, on December 7, 2017, US District Court Judge Mosman adopted the Findings and Reasonings of Magistrate Judge Papak denying plaintiff's motion for leave to amend his complaint. 2017 WL 606306. According to the court, Corizon was not liable under the ADA, the Rehabilitation Act, or state law because it was not a public entity or a public accommodation. Plaintiff's motion for leave to amend, then, was denied for futility. The court also adopted the magistrate's order granting summary judgment and dismissed the case. 2017 WL 6063065. The plaintiff appealed.

On January 19, 2019, the Ninth Circuit Court of Appeals affirmed the district court's decision except with respect to the state law claim. 775 Fed.Appx. 301. On that claim, the Ninth Circuit remarked that whether a private entity could be a "public accommodation" under Oregon state law was a matter of first impression. It therefore remanded to the district court with directions to consider whether it could exercise supplemental jurisdiction over the state law claim.

The case was reassigned to Magistrate Judge Jolie A. Russo on remand. After considering plaintiff’s motion for leave to amend his complaint and certify the question to the Oregon State Supreme Court, Magistrate Judge Russo recommended these motions be denied. On December 5, 2019, Judge Mosman adopted the magistrate judge's recommendation and dismissed the case without prejudice. As Judge Mosman interpreted the Ninth Circuit's prior decision, he was only required to determine the district court's jurisdiction over the state law claim, which he found satisfied under diversity jurisdiction. The plaintiff appealed this decision as well.

On January 28, 2021, the Ninth Circuit Reversed the district court. 985 F.3d 1198. It certified the following state-law question to the Oregon Supreme Court for clarification: “Whether private entities that provide services at a local correction facility are excluded from the definition of ‘a place of public accommodation’ and therefore exempt from Or. Rev. Stat. § 659A.142?” The district court retained jurisdiction over future proceedings.

The case is on-going as of 12/3/2021.
