In January 2000, the EEOC brought this suit against Columbia Alaska Regional Hospital in the U.S. District Court for the District of Alaska. We do not have a copy of the complaint; therefore, the exact allegations involved are unknown. However, it appears from a Court memorandum that the complaint alleged that the defendant discriminated against the charging party, a Black employee, on the basis of race in violation of Title VII of the Civil Rights Act of 1964 by subjecting him to a mandatory appraisal period after he was transferred. The charging party intervened in the suit in May 2000. The defendant filed a partial motion to dismiss one of the claims against it in September 2000 which was granted a few months later in November. After some discovery, the EEOC and the defendant settled through a consent decree in August 2001. The defendant then filed a motion for summary judgment against the charging party in September which was denied a month later. After some scheduling orders, the charging party and the defendant participated in a trial by jury in August 2002 which resulted in a directed verdict for the defendant. The charging party filed a notice of appeal in September 2002. However, the Court of Appeals affirmed the District Court's judgment in May 2005, the U.S. Supreme Court denied certiorari on October 11, 2005.
