In March 2005, the EEOC, out of their Baltimore, Maryland office, instituted this suit against the Maryland Classified Employee's Association, Inc., in the U.S. District Court for the District of Maryland (Northern Division). They alleged that the defendant had violated Section 703(a) of Title VII of the Civil Rights Act of 1964 by retaliating against an employee by discharging him for participating in an ongoing EEOC investigation into a sexual harassment complaint against his employer. The charging party intervened in this suit in October 2005.

Following a settlement conference in July 2006, the parties proposed and had approved a consent decree amenable to all. This decree, entered in August of 2006, provided for monetary damages for the charging party as well as injunctive relief to bring MCEA into compliance with Title VII as well as other anti-discrimination statutes. In July 2008, the parties filed a joint motion to extend the consent decree by 18 months and require internal compliance monitoring. An order granting this motion was entered July 24, 2009. Again, in February 2010, shortly before the consent decree was set to expire, the parties agreed to extend the decree by 60 days; an order granting this motion does not appear in the docket, however. As there is no further activity on the docket sheet, presumably, this case closed in February 2010.
