In July 2001, the Houston District Office of the EEOC filed this suit against the Housing Authority of the City of Port Arthur, TX in the U.S. District Court for the Eastern District of Texas alleging violations of the Age Discrimination in Employment Act. Specifically, the defendant forced one of the charging parties, a male employee, to involuntarily retire when he reached age seventy. In addition, the defendant required another female employee to work a reduced number of hours after she turned seventy years old. In December 2001, the parties settled through a consent decree. Under the terms of the decree, which included both anti-discrimination and anti-retaliation clauses, the defendant agreed to pay the charging party $22,500 and to give him a written offer of employment for reinstatement to his previous position.
