EEOC's Philadelphia, PA office filed this lawsuit alleging racial discrimination and wrongful termination against the defendant Jerith Manufacturing Company. The complaint was filed at the United States District Court for the Eastern District of Pennsylvania (Philadelphia) on 10/13/2005. EEOC represented a former black supervisor and a class of similarly situated black employees at defendant's Philadelphia facility. It was alleged that the black supervisor was terminated based on uncorroborated rumors of having a romantic relation with a subordinate employee while other white supervisors were not terminated for allegedly engaging in the same activity. The individual complainant intervened in the lawsuit.
A settlement conference was held before Magistrate Judge Jacob P. Hart on 07/20/2006. The parties settled before 08/18/2006 and a consent decree was entered into judgment on 09/18/2006.
The consent decree lasted for 18 months and the defendant agreed to pay $50,000 to settle the case. It also required the defendant to conduct Title VII training, expunge the employment record of the complainant, provide a neutral reference to the complainant, develop and disseminate a new anti-discrimination policy, certify compliance to the EEOC, and refrain from discrimination and retaliation. The docket sheet doesn't show any further enforcement took place; the case was presumably closed in 2008.
