The Baltimore District Office of the EEOC brought this action in the U.S. District Court for the District of Maryland, against A.E. Sweeney Masonry, Inc. The complaint, filed in September 2005, alleged race discrimination in violation of Title VII of the Civil Rights Act of 1964. Specifically, the complaint alleged that Defendant subjected the charging parties to harassment, gave them more difficult job assignments, transferred them involuntarily because of their race, African American, and also discharged them in retaliation for engaging in conduct protected under Title VII. In March 2006 a consent decree was entered through the Philadelphia District Office.

The decree, valid for four years, required Defendant to pay the two charging parties, $30,000 each in compensatory damages, provide them with neutral employment reference, expunge their employment records and offer to reinstate their jobs with retroactive seniority and with all benefits. Defendant was enjoined from discriminating or retaliating in violation of Title VII, and required to adopt and distribute a policy against discrimination and harassment, post an EEO notice at its facility, provide EEO training to its current and future employees, maintain records according to Title VII's record-keeping requirements and report any complaints of harassment/discrimination to the EEOC within seven days of the complaint. The docket sheet does not show any further enforcement took place; the case was presumably closed in 2010.
