In September 2000, the EEOC district office in St. Louis, Missouri brought this action against the Arnold R. Spirtas Company, the Spirtas Company, Central C&D Recycling, Inc., and the Spirtas Wrecking Company in the U.S. District Court for the Eastern District of Missouri. The EEOC alleged the the defendants unlawfully discriminated against blacks when it refused to pay them as much as white coworkers, refused to hire blacks who would not accept less pay, and discharged those who complained, all in violation of Title VII of the Civil Rights Act of 1964.

After a successful attempt at ADR, the parties settled and a consent decree was entered in October 2001. The parties agreed that the defendant would pay $140,000 to the complainants, $75,000 in attorney's fees, post an EEO notice, comply with posting requirements in 29 C.F.R. section 1601.3, implement an anti-discrimination policy, and issue complaint and compliance reports to the EEOC. The terms of the decree ran for two years.
