On September 19, 1990, prisoners at the Virginia State Penitentiary filed a class action lawsuit for declaratory and injunctive relief under 42 U.S.C. § 1983 against the Virginia Department of Corrections in the U.S. District Court for the Eastern District of Virginia. The plaintiffs, represented by the National Prison Project of the American Civil Liberties Union, alleged that the defendants had violated their rights under the 8th Amendment and the 14th Amendment by subjecting them to life-threatening conditions in the areas of fire safety, environmental health, and environmental safety. Since we only have the complaint for this case on record, we have no further information on the proceedings.
