Abstract The Diocese alleges that the HHS mandate places a “substantial burden” on its right to free exercise of religion in violation of the Religious Freedom Restoration Act and the First Amendment. Further, the Diocese charges that the HHS mandate excessively entangles the government in religion and interferes in internal church governance in violation of the First Amendment’s Establishment Clause and that it compels speech in violation of the First Amendment’s free speech guarantee. Finally, the Diocese argues that the mandate was issued in violation of the Administrative Procedure Act.
