Reproductive Rights After Dobbs: Georgia Supreme Court Upholds Abortion Ban

The Georgia Supreme Court, in SisterSong Women of Color Reproductive Justice Collective v. Georgia, recently upheld a state statute prohibiting and criminalizing abortion after six weeks of pregnancy with limited exceptions. The court reasoned that although the challenged statute was enacted in 2019, post-Roe and pre-Dobbs, it was not void ab initio because the challenge to the statute was not filed until after Dobbs, under which the statute passed constitutional muster.
