"In a case challenging conditions at the Medium Security Unit of the Nebraska State Penitentiary, the court held that there was no violation of the Eighth Amendment. However, the court did note

that those conditions "are potentially close to creating intolerable conditions ... unless remedial measures are implemented." Kitt v. Ferguson, 750 F. Supp. 1014, 1019 (D. Neb. 1990), affd without opinion, 950 F.2d 725 (8th Cir. 1991)."
