The Court returned to the parties their courtesy copies of the Cross-Motions for Summary Judgment (and retained the courtesy copy of the Administrative Record) under the assumption that the class certification ruling will affect the issues on which the parties request summary judgment and will accordingly narrow the Cross-Motions themselves. The Court GRANTS IN PART AND DENIES IN PART Plaintiffs Motion for Class Certification. (SEE DOCUMENT FOR SPECIFICS RE TOLLING PROVISIONS CLAIM AS ENUMERATED HEREIN ). The Court appoints Carlos Abel Hernandez Arevalo and Rene Isai Serrano Montes as class representatives, and the Court appoints Peter Schey and Sarah Kahn of the Center for Human Rights and Constitutional Law as class counsel. The Court further finds that the missed deadline claim is not appropriate for class certification and denies the Motion to that extent. Furthermore, to provide the parties with an opportunity to amend their summary judgment motions in light of this Order, the Court ORDERS as follows: Amended Cross-Motions for Summary Judgment must be filed no later thanJune 26, 2023. If a party does not file an amended motion by this date, theCourt will assume that party has elected to stand on its previously filed motion. Oppositions are due no later than July 10, 2023.
