Case Summary

(This summary is temporary while we research the case further). On October 10, 2023, the North Carolina General Assembly enacted Senate Bill 749 (SB 749). SB 47 would have increased the total number of State Board of Election members from five to eight, and the General Assembly would appoint all members. Prior to SB47, the Governor appointed all members from a lists of eight nominees. 

On October 17, the Governor of North Carolina sued the Speaker of the North Carolina House of Representatives and the President Pro Tempore of the North Carolina Senate, alleging that SB47 was unconstitutional.

On April 23, 2025, a three-judge panel granted the Governor's motion for summary judgment and blocked SB47. The case is ongoing.
