PAPERLESS ORDER granting 11 Plaintiffs' Motion for Leave to Proceed Under Pseudonyms and to File Names Under Seal ("Motion"). In their Motion, Plaintiffs seek leave to proceed under the pseudonyms C.M., J.M.C., E.R., and N.M.B. and to file their unredacted declarations in support of this Motion under seal. Plaintiffs seek this leave because they fear public disclosure of their identities could lead to political persecution and torture; retaliation and harassment by law enforcement, immigration officials, and members of the public; and other harms. Mot. at 3-5."Whether a party's right to privacy outweighs the presumption of openness is a 'totality-of-the-circumstances question.'" Doe v. Neverson, 820 F. App'x 984, 986 (11th Cir. 2020) (quoting In re Chiquita Brands Int'l Inc., 965 F.3d 1238, 1247 n.5 (11th Cir. 2020)). Factors that may counsel courts to grant anonymity to the parties include whether the plaintiffs are challenging government conduct, whether the plaintiffs would be threatened by violence or physical harm by proceeding in their own names, and whether their anonymity would pose a unique threat of fundamental unfairness to the defendant. See Plaintiff B v. Francis, 631 F.3d 1310, 1315 (11th Cir. 2011). The Motion establishes that Plaintiffs have a substantial privacy right in proceeding under pseudonyms in this action given that they face the potential of substantial harm in the United States and in their countries of origin from attaching their names to these proceedings. Accordingly, given that Plaintiffs have established good cause in support of their requested relief, the Motion is GRANTED. Plaintiffs may proceed in this action using the pseudonyms listed in their filings. Signed by Judge Rodolfo A. Ruiz, II on 7/18/2025. (gp) [Transferred from flsd on 8/20/2025.] (Entered: 07/18/2025)

PAPERLESS ORDER granting Plaintiffs' Second Motion for Leave to Proceed Under Pseudonyms and File Names Under Seal ("Second Motion"), [ECF No. 31]. In their Second Motion, Plaintiffs seek leave to proceed under the pseudonyms G.T.C., F.B., R.P., A.S., and G.M.S.G. and to file their unredacted declarations in support of this Second Motion under seal. Plaintiffs seek this leave because they fear that public disclosure of their identities could lead to political persecution and torture; retaliation and harassment by law enforcement, immigration officials, and members of the public; and other harms. Second Mot. at 3-5. "Whether a party's right to privacy outweighs the presumption of openness is a 'totality-of-the-circumstances question.'" Doe v. 2011). The Court has already granted a motion to allow other Plaintiffs in this action to proceed under pseudonyms, and it does so here for similar reasons. See Paperless Order, [ECF No. 15]. The Second Motion establishes that Plaintiffs have a substantial privacy right in proceeding under pseudonyms in this action given that they face the potential of substantial harm in the United States and in their countries of origin from attaching their names to these proceedings. Accordingly, given that Plaintiffs have established good cause in support of their requested relief, the Second Motion is GRANTED. To the extent that the Renewed Motion relies on or references declarations or exhibits attached to the Expedited Motion, the Court will consider these declarations or exhibits as part of the record. PAPERLESS ORDER denying as moot Plaintiffs' Motion for Class Certification ("First Motion"). [ECF No. 6]. Plaintiffs have filed a Renewed Motion for Class Certification ("Renewed Motion"). [ECF No. 30]. Accordingly, Plaintiffs' Motion for Class Certification, [ECF No. 6], is DENIED as moot. PAPERLESS ORDER on Plaintiffs' Motion for Clarification ("Motion"), [ECF No. 42]. The Motion "requests confirmation" that the Court will consider Plaintiffs' Renewed Motion for Class Certification, [ECF No. 30], during the August 18, 2025 Hearing on Plaintiffs' Renewed Motion for Preliminary Injunction ("Hearing"), [ECF No. 27] at 2. The Court will not consider Plaintiffs' Renewed Motion for Class Certification at the Hearing. The Court's Order Setting Briefing Schedule, [ECF No. 27], was clear that "[t]he Court will hold an in-person Hearing on Plaintiffs' Renewed Motion for Preliminary Injunction." Id. at 2 (emphasis added); see also July 28, 2025, Status Conference Tr. at 58:13-14 (noting that the Court would prefer to set "a hearing on the PI" no later than August 18). This is why the Court set a briefing schedule solely on Plaintiffs' Renewed Motion for Preliminary Injunction. The Court recognizes that issues related to class certification may be relevant in determining the likelihood of success on the merits of Plaintiffs' Renewed Motion for Preliminary Injunction. See A.A.R.P. v. Trump, 145 S. Ct. 1364, 1369 (2025) ("A court considering whether to issue preliminary injunctive relief must consider whether the movant is likely to succeed on the merits. And to consider whether a request for classwide relief is likely to succeed on the merits, a court must at least consider whether class certification is likely."); see also July 28, 2025 Status Conference Tr. at 64:13-24 (noting the interplay between injunctive relief and class certification, and further noting that a "preliminary peek" at the class certification motion would help "determine success of likelihood on the merits"). While the Court will not hear argument on Plaintiffs' Renewed Motion for Class Certification, the parties should be prepared to address the interplay between the proposed class and subclass and the likelihood of success on the merits of Plaintiffs' claims. Signed by Judge Rodolfo A. Ruiz, II on 8/4/2025. (nn00) [Transferred from flsd on 8/20/2025.] (Entered: 08/04/2025)

PAPERLESS ORDER on Order Granting in Part and Denying in Part Plaintiffs' Motion for Expedited Discovery ("Order"), [ECF No. 41]. The Order indicated that "Defendants shall respond to Plaintiffs' discovery requests on or before August 7, 2025." Order at 5. These discovery requests include responses to two of Plaintiffs' Interrogatories, which ask Defendants to "[i]dentify all federal, state, and/or local government agencies that have legal custody over people detained at Alligator Alcatraz" and to "[i]dentify all federal, state, and/or local government agencies and contractors that are responsible for carrying out detention operations at Alligator Alcatraz." Id. at 6. The Local Rules state that interrogatories "shall not be filed until they are used in the proceeding or the court orders their filing." See S.D. Fla. Loc. R. 26.1(b). For clarity of the record, and to assist in the effective disposition of Plaintiffs' Renewed Motion for Preliminary Injunction, [ECF No. 29], the Court requests that Defendants file their answers to Plaintiffs' interrogatories on the public docket on or before August 7, 2025. Further, Defendants did not indicate in their Combined Response to Plaintiffs' Motion for Expedited Discovery, [ECF No. 37], that their responses to Plaintiffs' discovery requests, namely the production of certain documents, would need to be filed under seal. Unless protective measures are sought in the interim, the Court expects that documents responsive to Plaintiffs' document production request, as specified in the Court's Order, shall be filed on the public docket, along with responses to Interrogatories 1 and 2, on or before August 7, 2025.
