In Sierra Club and Southern Border Communities Coalition v. Trump and State of California v. Trump, the U.S. Court of Appeals for the Ninth Circuit ruled that President Trump cannot lawfully divert funds that Congress has appropriated for other purposes for the construction of a border wall between the U.S. and Mexico. In so ruling, the Ninth Circuit affirmed the district court’s injunction preventing the construction of a border wall using funds that were otherwise appropriated. Now, Sierra Club and Southern Border Communities Coalition are asking the Supreme Court to lift a stay it granted of the district court’s injunction.
