Resource: di Genova-Chang v. Ducey

Citing multiple federal laws (Public Health & Welfare, Civil Rights Act, Voting Rights Act of 1965, Help America Vote Act 2002, National Voter Registration Act of 1993; Voting Accessibility for the Elderly & Handicapped Act of 1984), Plaintiff (Arizona resident) filed suit against Arizona's Governor and the State's Dept. of Elections alleging that: (1) the Governor's refusal to delay Arizona's primaries caused mass Covid-19 infection; and (2) the Governor is failing to protect public health and safety by (i) refusing to allow State employees and election officials to work remotely, and (ii) requiring candidates to gather signatures and file petitions in person. Plaintiff sought an order that: (1) the Governor repay his salary; (2) the State fund all medical costs for Arizonans who contract Covid-19; (3) punitive damages be imposed against the Governor and the Dept. of Elections for "incompetence and willful neglect of health and safety"; (4) the results of the primary elections be declared "null and void"; and (5) primary elections be held again.
