The IDEA mandates that a state must provide a Free Appropriate Public Education (FAPE) to every child with a disability as a prerequisite to receiving federal funding to help educate children with disabilities.

In Jamie S. v. Milwaukee Public Schools, the United States District Court for the Eastern District of Wisconsin delivered an opinion holding that Milwaukee Public Schools (MPS) and the Wisconsin Department of Public Instruction (DPI) violated the IDEA by failing to comply with the requirements of Child Find.
