Respondents appeal a district court order granting petitioners’ emergency motion for a temporary injunction prohibiting enforcement of provisions of Iowa Code section 146E.2 (2023)(“Abortion—fetal heartbeat—exceptions”). Respondents argue: (1) the constitutionality of abortion regulations under the Iowa Constitution should be reviewed using the rational basis test; and (2) petitioners lack standing to bring their claims for declaratory and injunctive relief, which were not ripe for review.
