Resource: Graham v. Adams (also Kentucky v. Graham)

State court challenge to congressional and state House maps based on alleged partisan gerrymandering and improper county-splitting in violation of the state constitution. On Nov. 10, 2022, the trial court rejected the challenges. On Dec. 14, 2023, the state Supreme Court affirmed the trial court’s determination. Although the state Supreme Court wrote that the plaintiffs had standing to sue and that claims of partisan gerrymandering are justiciable, the majority held that in gerrymandering cases the Court should “apply a substantially deferential standard given the political nature of the apportionment process,” and found that the challenged maps did not rise to the level of a “clear, flagrant, or unwarranted deviation from constitutional limitations or a threat to our democratic form of government.”
