Resource: Fason et al. v. Hamlet et al.

The Arkansas Post-Prison Transfer Board (PPTB) and the Arkansas Department of Corrections (ADC) administer parole revocation hearings that blatantly violate the rights of Arkansans on parole, including the right to appointed counsel for qualifying low-income individuals. Thousands of people have been forced back into prison because of these unconstitutional proceedings. The MacArthur Justice Center’s National Parole Transformation Project, along with co-counsel from the ACLU of Arkansas and Latham & Watkins LLP, is fighting to return due process rights to Arkansans facing parole revocation and ensure that Arkansas officials fulfill their duty to appoint counsel at parole revocation hearings.
