In the early '80s, a detainee filed this case against the City of Overland and various officials in the United States District Court for the Eastern District of Missouri, claiming violations of her Fourth Amendment rights arising out of her detention and strip search.
A jury found for the Plaintiff, except as to two defendants, and the remaining defendants moved for a new trial.
On September 4, 1984, the Court (Judge Cahill) denied the motions, holding that the city was liable for violating detainee's constitutional rights in conducting strip search without belief that detainee possessed contraband or weapons and without circumstances warranting such search; that good faith immunity shielded public officials who implemented the search; and that the question of one official's intent to punish detainee in implementing strip search was question for jury.
