[This summary is temporary while we research the case.] This is a lawsuit related to the use of a test known as the PPST, which is meant to test basic skills at the twelfth-grade level, as a condition for admission into a state-approved teacher education program. The plaintiffs (which included the NAACP) alleged that the PPST was racially discriminatory and violated the Equal Protection Clause, the Due Process Clause, Title VI of the Civil Rights Act of 1964, the Equal Educational Opportunities Act, and the contract between the United States and the State of Texas guaranteeing equal opportunity in higher education. The case was filed on March 23, 1971, in the United States District Court for the Eastern District of Texas.
