[This summary is temporary while we research the case.] This is a lawsuit in which the plaintiffs challenged the constitutionality of Article XXXIV of the California State Constitution, which required low-rent housing projects to be approved by a majority of qualified electors. The plaintiffs argued that this provision violated the Equal Protection Clause by disproportionately burdening low-income individuals and racial minorities. The case was filed on October 1, 1969, in the United States District Court for the Northern District of California.
