Case Summary
In 2011, an undergraduate student at Glenville State University in West Virginia filed a complaint with the US Department of Education, Philadelphia Office for Civil Rights (OCR). The complainant alleged that the University failed to respond promptly and equitably to her report of sexual assault, forced her to withdraw from school, and failed to notify her of its Title IX grievance procedures. On February 2, 2011, OCR announced that it was opening an investigation into the allegations.
On January 12, 2012, before OCR concluded its investigation, the University entered into a voluntary resolution agreement with OCR. Without admitting liability, University officials promised to change a number of the school's Title IX policies and practices. In exchange for the University's compliance with the terms of the agreement, OCR agreed to close the investigation. Specifically, Glenville State University agreed to:
- Investigate the complainant’s sexual assault allegations and provide her with a written summary of findings and any corrective actions taken;
- Remedy the effects of the sexual assault on the complainant, including reimbursement of related medical and academic expenses and an invitation to the complainant to reenroll, if and only if the University found the complainants allegations substantiated;
- Revise its Title IX grievance procedures to address complaints of sex discrimination and submit the proposed policy to OCR for approval;
- Revise its notice of nondiscrimination to include a statement that the policy extends to employment and admissions and include the contact information of the Title IX Coordinator;
- Designate a Title IX Coordinator, delineate the responsibilities, and publish the individual’s contact information;
- Conduct training for the Title IX Coordinator and individuals involved in Title IX compliance;
- Conduct training for all University staff on preventing, recognizing, and responding to sexual misconduct;
- Develop a memorandum of understanding with local law enforcement;
- Create a campus focus group made up of students, faculty, and staff designed to provide input to the University on effective Title IX policies;
- Designate an individual from the University’s counseling center to be “on call” at all times to assist victims of sexual violence;
- Review campus police records from the prior two school years to ensure that the school took appropriate action and did not treat complaints of sexual misconduct as solely criminal matters;
- Conduct an annual climate check to ensure a campus free from sexual harassment; and
- Submit to ongoing monitoring by the OCR to ensure compliance with the agreement.
The parties agreed that OCR would oversee compliance with the agreement through at least June 30, 2014. As of this writing, there was no further activity on the docket and the case is presumed closed.
