For its September 1st primary election, Massachusetts has allowed applications to be received until August 26, but the state has not adjusted its receipt deadline from September 1st. Plaintiffs sue under the Massachusetts and U.S. Constitutions to require the state to count all ballots postmarked by September 1st and received at least ten days after that date.
