After Governor Cuomo issued Executive Order 202.23, which canceled the June 23, 2020 Special Election for Queens Borough President, Dao Yin and Jay Yee, two candidates, filed a complaint seeking a preliminary injunction and temporary restraining order against the Executive Order. The Court denied the petition. This ruling was affirmed by the Appellate Division Court for the Second Judicial Department on different grounds.
