The ACLU of New Mexico, representing a few thousand local voters, especially Hispanic voters, along with one individual city resident filed suit in the in the U.S. District Court for the District of New Mexico on October 27, 2005. The plaintiffs named Albuquerque city clerk Judy Chavez as the defendant, representing the City. The plaintiffs were represented by local litigation and civil rights law firms, and the City was represented by the city attorney's office and a local civil trial firm. District Judge M. Christina Armijo and Magistrate Judge W. Daniel Schneider presided over the case. Plaintiffs cited the Equal Protection Clause of the 14th Amendment and the Civil Rights Act of 1964.

In their complaint, the plaintiffs challenged a 2005 amendment to the city's Election Code requiring all voters who vote in person in any municipal election to present a certain form of photo identification (the Voter ID Amendment). Specifically, in person voters would have to present one form of photo ID out of a given list of permissible types. People who voted by absentee ballot did not have to fulfill a similar burden. Thus, Plaintiffs sought injunctive and declaratory relief (as well as attorneys' fees) under two counts: Count I: a violation of the Equal Protection Clause by discriminating against persons who choose to vote in person, and Count II: a violation of the Civil Rights Act of 1964 for the same reason. They asked the court to hold the Voter ID Amendment unconstitutional and to stop the city from enforcing it. 

On January 3, 2006, the plaintiffs filed their First Amended Complaint adding as plaintiffs the League of Women Voters of Albuquerque, the SAGE Council (on behalf of local Native Americans), the New Mexico Coalition to End Homelessness, and two individual city residents. This complaint also replaced defendant Chavez with Millie Santillanes, who replaced Chavez as the city clerk.

On April 24, 2006, the plaintiffs filed their Second Amended Complaint, setting forth six counts. Count I alleged an undue discriminatory burden on the fundamental right to vote in violation of the Equal Protection Clause, specifically with regard to people who vote in person at the end of a campaign. Count II alleged discrimination in violation of the Equal Protection Clause because the Voter ID Amendment required some degree of affluence unattainable by homeless individuals, and also no permissible form of photo ID was gender-neutral. Count III alleged violation of the Civil Rights Act of 1964, 42 U.S.C. 1971(a)(2)(A) because the Voter ID Amendment required more from in-person voters than from absentee voters. Count IV further alleged violation of the Civil Rights Act of 1964, 42 U.S.C. 1971(a)(20)(B) because the photo ID requirement denied the right to vote to people who were otherwise qualified and could confirm their identity by other means. Count V alleged a violation of Section 2 of the Voting Rights Act of 1965, 42 U.S.C. 1973(a) because Hispanic and Native American voters are less likely than white voters to have the specified forms of photo ID. Count VI alleged a violation of the plaintiff's First Amendment rights because the act of voting is an act of speech. 

After a period of gathering evidence, the City filed a motion for summary judgment on September 13, 2006, and the plaintiffs filed a motion for summary judgment the next day, on September 14, 2006. The same day, the Brennan Center filed an amicus brief supporting the plaintiffs' motion. On October 10 and 11, 2006, the parties responded to each other's motions, and the American Center for Voting Rights Legislative Fund filed an amicus brief supporting the defendant's motion. On October 26, 2006, the parties completed briefing. 

On February 12, 2007, Judge Armijo granted in part and denied in part both parties' motions for summary judgment, ultimately declaring unconstitutional and enjoining enforcement of Albuquerque's photo ID requirement. Specifically, the plaintiffs won their Count I Equal Protection claim in the Second Amended Complaint, but the City won on the Count VI First Amendment claim. The other counts were undecided. The judge issued a final order on this decision on March 6, 2007 and issued a permanent injunction.

On March 7, 2007, the City appealed the summary judgment decision. On March 21, 2007, the plaintiffs cross appealed, but they later agreed to dismissal of this cross appeal on April 13, 2007. The City's appeal proceeded in the Tenth Circuit, and on December 9, 2009, the appeals court reversed the lower court's decision.

Specifically, the Tenth Circuit confirmed that the plaintiffs had standing and then made the following determinations. First, the court decided that the law properly distinguishes between in-person and and absentee voters, because the in-person and absentee voting are fundamentally different processes and all citizens can choose between both options. Second, the court found that the lower court improperly balanced the burden of the Voter ID Amendment with its justifications by imposing too high of a burden on the City, as clarified by the 2008 Supreme Court decision in Crawford v. Marion County Election Board, which was decided after the lower court's decision here.

Applying Crawford, the Tenth Circuit found that the burdens of the City's photo ID law arose out of life's vagaries and did not amount to a substantial burden, that preventing fraud and voter impersonation were sufficient justifications for the photo ID requirement, and that the City did not need to provide evidence of past instances of fraud to use this justification. Further, the Tenth Circuit found that the City's photo ID requirement was not unconstitutionally vague and did not conflict with certain other local and federal laws.

Ultimately, the Tenth Circuit rejected the lower court's reasoning and determined the Voter ID Amendment was constitutional, reversing the lower court's decision. Thus, on appeal, the plaintiffs lost the entire case. Pursuant to the appellate judgment, Judge Armijo of the District of New Mexico dismissed the case on December 10, 2008.
