Case Summary

(This summary is temporary while we research the case.) Planned Parenthood sought to have certain provisions of Mo. Rev. Stat. § 211.411 et al., declared unconstitutional and for an injunction against the enforcement of the challenged provisions. Planned Parenthood brought suit against defendants, the Attorney General of the State of Missouri and a city attorney, as representative of a class of physicians who perform abortions as well as individually. The District Court held that the part of the statute providing for the same standard of care for the protection of the fetus at any stage of pregnancy was unconstitutional and the matter reached the United States Supreme Court.
