[This summary is temporary while we research the case.] This is a lawsuit in which the plaintiff, a man incarcerated in the Nevada state prison system, sued prison officials, alleging that they had violated the Eighth Amendment to the United States Constitution by forcing him to be exposed to environmental tobacco smoke (ETS). The plaintiff claimed that this exposure posed a risk to his health and therefore should be categorized as cruel and unusual punishment. The case was filed on January 28, 1987, in the United States District Court for the District of Nevada.
